START THE BUSINESS- This visa category is for an overseas parent company looking to send a senior individual to the UK to establish a branch or subsidiary. There are two steps involved in the process before an individual can come to the UK:
- The UK branch or subsidiary must first apply for an Expansion Worker - Sponsor License. Once the license is granted, the senior individual can proceed to the next step.
- The senior individual will need to submit a Global Business Mobility - Expansion Worker visa application from a country where they have legal residence, other than as a visitor.
- As part of the Sponsor License application, the company will need to demonstrate the following:
- A UK footprint, including company incorporation, a bank account, and office space.
- An overseas trading presence of at least 3 years, with credible plans to expand to the UK and establish a trading presence within two years. The branch or subsidiary must be in the same type of business as the parent company.
- If the application is successful, the branch or subsidiary will be granted a 'provisional' license, which is valid for four years. However, during the first two years, the branch or subsidiary must establish a trading presence and apply to add either the Skilled Worker or Global Business Mobility - Senior or Specialist tiers to its license, converting the license status from 'provisional' to 'A-rated.'
- The senior individual coming to the UK will also need to convert their Expansion Worker visa to a Skilled Worker or GBM- Senior or Specialist Worker visa to extend their stay in the country.
